Terms & Conditions — Thyme and Tale

1. Who we are

1.1. This website is operated by Thyme and Tale.

2. Definitions

2.1. “Goods” — printed items, digital prints, original artworks, unframed works, and any other products sold on this site.
2.2. “Bespoke” or “personalised” — items made specifically to a customer’s instructions (e.g. commissioned original artwork, personalised prints).
2.3. “Contract” — the agreement between you and Thyme and Tale for sale of Goods.

3. Orders and acceptance

3.1. Placing an order on the website is an offer to buy the Goods. We will confirm receipt of your order by email (order acknowledgement). A contract is formed only when we send an order confirmation email.
3.2. If we cannot supply the Goods (e.g. sold out, or we cannot meet a bespoke request), we will inform you and give the option of a refund or substitution.

4. Price & payment

4.1. Prices shown include VAT where applicable unless stated otherwise. Delivery charges are shown at checkout.
4.2. Payment is taken when the contract is formed. We accept Card payment only. We will not dispatch goods until payment has cleared.

5. Delivery — timescales and standards

5.1. We will deliver within any time stated in the product listing or, if no time is stated, within 30 days of the date of the contract unless we agree otherwise in writing. (If we cannot meet the stated/expected delivery time we will contact you.)
5.2. Shipping options, cost and estimated delivery times are presented at checkout. Where you choose an expedited service, you pay the extra cost. If you choose a premium delivery and we offer a standard alternative, we are only required to refund the standard delivery cost when giving a refund for cancellation.
5.3. Risk in the Goods passes to you on delivery, but the legal ownership (title) remains with us until we have received payment in full.

6. Parcel loss, damage in transit and inspection

6.1. Please inspect your Goods on delivery. If Goods arrive damaged or with manufacturing faults, notify us within 48 hours of delivery by emailing thymeandtale@outlook.com with photos and order number. We will advise return/collection and will cover reasonable return postage for faulty or damaged items. (See section 9 on faulty goods.)

7. Cancellation & your right to change your mind (distance sales)

7.1. For most online purchases (e.g. prints bought from stock) you have a legal right to cancel the contract under the Consumer Contracts Regulations. You must notify us within 14 days of receiving the goods that you wish to cancel and then return the goods within a further 14 days. We will refund you within 14 days of receiving the goods back (or proof of postage), subject to deductions for any diminished value where appropriate.
7.2. Bespoke/personalised items and commissioned original artworks are exempt from this right to cancel where the goods are made to the customer’s specifications or are clearly personalised. If your order is bespoke/personalised, we will state this on the product page, and you will not have the statutory 14-day ‘cooling off’ right — you can still request a repair/replacement or refund where the item is faulty.

8. Returns for non-faulty standard prints (our voluntary policy)

8.1. If you simply change your mind about a non-bespoke print, tell us within 14 days of delivery and return the item in its original condition and packaging within 14 days. Return postage is at your cost unless we state free returns. We recommend using a tracked service and obtaining proof of postage.
8.2. We reserve the right to deduct for any undue damage or excessive handling that reduces the resale value.

9. Faulty or misdescribed goods (your statutory rights)

9.1. If the goods are faulty, not as described or of unsatisfactory quality you have rights under the Consumer Rights Act 2015. You have a short-term right to reject faulty goods and obtain a full refund if you notify us within 30 days of receiving the goods (subject to the Act). After 30 days, you may request a repair or replacement.
9.2. If we accept that a refund is due, we will refund the full amount paid for the goods and any standard delivery cost within 14 days of us receiving the returned goods (or proof of posting). If you selected a faster delivery method than our standard option, we are only required to refund the cost of the cheapest standard delivery offered.

10. How to return

10.1. To return, email thymeandtale@outlook.com with your order reference (Customer name and postcode) and reason. We will provide return instructions and the return address. For faulty items we will provide a returns label where appropriate.
10.2. We recommend insured and tracked returns for valuable items (e.g. original artworks). We are not responsible for items lost in return transit unless we issued the return label and instructed to use that service.

11. Refunds timing and method

11.1. Refunds will be made to the payment method originally used unless otherwise agreed. We will process refunds within 14 days of receiving the returned goods or proof of postage (or, for cancellations where we collect, 14 days from the date you notify us).

12. Exchanges

12.1. Exchanges are treated as a return + a new order. Contact us for return approval and place a new order for the replacement item.

13. Liability & limitations

13.1. We are responsible for foreseeable loss caused by us. Nothing in these Terms limits or excludes our liability for death or personal injury caused by our negligence, fraud or fraudulent misrepresentation, or any other liability that cannot be limited by law.
13.2. For the avoidance of doubt, we will not be liable for normal wear and tear, or for damage caused by improper handling once the Goods have been delivered and accepted.

14. Intellectual property

14.1. All artwork, images and text on the site are copyright Thyme and Tale original illustrations created by Sarah Sherwood. You may purchase prints for personal use only; resale or reproduction requires a separate licence.

15. Governing law

15.1. These Terms are governed by the laws of England and Wales (or Scotland / Northern Ireland if you prefer to specify). Disputes should be raised with us in the first instance, if unresolved consumers may escalate to Alternative Dispute Resolution (ADR) or the small claims court.
